Friday's Freaky Fatwa...Can a woman be a Judge?

A Muslim asks a scholar

Is it permissible for a woman to be a judge?

And the scholar replies

Praise be to Allaah.
The majority of scholars are of the view that it is not permissible for a woman to be appointed as a judge, and if she is appointed, the one who appointed her is sinning, and her appointment is invalid, and her judgements carry no weight, no matter what ruling she passes. This is the view of the Maalikis, Shaafa’is and Hanbalis, and of some of the Hanafis.
They quoted a number of opinions as evidence:

Quran 4:34; “Men are the protectors and maintainers of women, because Allah has made one of them to excel the other, and because they spend (to support them) from their means”
(Notice that brains are not mentioned)
Women cannot be appointed in charge because Allah has granted men a degree over women and if a woman were to be appointed as a judge that would contradict the degree that Allah has given the men in this verse and women would be the protectors and maintainers of men.

In order for a judge to judge between two disputants, he must have a degree over them.
Muhammad said: “No people will ever prosper who appoint a woman in charge of their affairs.” There is no sterner warning greater than stating that they will never prosper, and the most important issue is to rule according to the rulings of Allah, and therefore this warning applies more emphatically to women. The nature of woman means that a woman should not be appointed to a position of public authority and applies to any woman in any era.

And if all that isn’t good enough evidence, the following should prove that stupid is a learned principal.

The scholars continue with;
Practical experience in some countries indicates that women are not fit to play the role of judge.
In one of the Muslim countries the Ministry of Justice opened the door for talented women to become judges, but after five years they dismissed all of these female judges and banned women from entering the graduate school for judges because of their failure despite the opportunities they had for learning and training, and despite the fact that they got higher grades than the men in the theoretical field.

In another Muslim country women were given the opportunity to become judges, but after they failed the state had to remove them from the courts to the technical and research fields. This indicates that women are not qualified to be judges

Ok, pick your jaws up off the ground…here is more proof that Muslim men can’t be trusted…don’t know why they brag about it

The scholar’s wisdom
The judge is required to be present among men’s gatherings and to mix with disputants and witnesses, and may need to be alone with them. Islam seeks to protect women and preserve their honour and dignity, and protect them from those who would toy with them. So Islam tells women to stay in their homes and not go out except in cases of necessity. And it forbids them from mixing with men and being alone with them, because that poses a threat to women and their honour.

The position of judge requires a high level of intelligence, insight and reason, and women have less of these qualities than men, and they have little experience in the affairs of life and disputes.

And the Quran says….27:23 Lo! I found a woman ruling over them, and she hath been given abundance of all things, and hers is a mighty throne.

Now, who are you going to believe, the Quran or a silly man in a dress?



And speaking of dresses....

A Muslim asks a scholar

What is the ruling regarding bras for women? And in particular, bras that make the chest appear bigger then what is natural for the woman who wears them?

And the scholar replies

Praise be to Allaah.
It is permissible for women to wear bras so long as they are not tight or thin and show the size of the breasts, unless that is in front of her husband or she wears over it a loose, wide garment that covers it.
That is because women are enjoined to cover their ‘awrah with something that cannot be seen through and that does not show the shape.

Ahmad narrated that Usaamah ibn Zayd said:
The Messenger of Allaah gave me a thick Egyptian garment that was one of the gifts given to him by Dihyah al-Kalbi, and I gave it to my wife to wear.
He said, “Why do I not see you wearing that Egyptian garment?” I said, I gave it to my wife to wear.
He said, “Tell her to wear a gown underneath it, for I am afraid that it may describe the size of her bones.”
